Hi, I'm about to file for my little brother for the first time which just turned 16 years old last week, will he get an EAD too with his DACA if it's approved even is he is just 16? Also do I need to fill out the questions on the forms where it says preparer since he is underage? can I leave those questions blank? Thank you all for your help, I just don't if I should fill out the i-765 and i-765w does he need the EAD to get a ssn and ID??? Thanks again!

Yes, you should file the i-765 form for you brother. Once DACA is approved, the i-765 form will automatically be approved. Even if you brother is 16 and does not plan to work, it's important that he holds i-765 Work permit (has other uses such as identification).

Also, if you are preparing the forms, then you should sign it. The law typically doesn't honor signatures from minors, so it's better to play it safe and have it signed by you.

Don't forget to send a personal check or money order with your application! G'luck.

Thank you very much Razr but don't they look at what you write down on the i-765w to decide if you need the EAD or not? Because he is currently on High school and he will not be working till he graduates in 2 years, I don't know what to put on i-765w besides that he lives at home and that all his bills are paid by my parents do you think he will still get the EAD with those answers??? Do you know of anyone that got DACA but not the EAD? Both my sister and I got both since I'm 27 and she is 20 Thank you again and yes good point on the signatures!

Hi again,

For the i-765ws form, just be honest about your brother's expenses (e.g. food, even if your parents are footing the bill). For annual income, put down zero. For reason why you need the EAD for your brother, simply explain that he is 16 and going to school full time. The bottom line is that i-765ws form is just a formality; it doesn't carry much wait in the decision process.

I suppose it is possible to only be given DACA, but that has not been the case in my experience. If you search this forum, people who are minors have received both. Hope I helped.

on I-765WS you can explain that he is planning to go to college (maybe?) and needs to work to save for college payments. And absolutely, you should put your name under 'Preparer', and you both (your brother and you) must sign the application. That's how it has to be done properly.
