When DACA first started it proved the uselessness of lawyers about this process. However if ur lawyer is asking u to try it, it s worth it to at least ask him/her why? At this point the program has been in affect so long that im sure they know all the ins and outs, and all the loopholes they can use to help u get approved even if u otherwise wouldn't be. The problem with trusting a lawyer is that they are lawyers and are mostly concerned about money and not your well being. If u have documents (a bank account, mail, ANYTHING!) that is dated prior to June 15th, u could give it a go, cuz they really cant prove that u weren't here.

$465 is a lot of money, so be careful before u make a move. I sure do hope ur lawyer isn't just pulling ur leg, cuz DACA does make one feel liberated.

Two questions that need to be addressed in the context of whether or whether not it is worth trying would be, I would think:

How absolute the cut-off is (i.e. discretionary or strict guideline enforced). Something you'd want to learn as much as you can about.

Bear in mind, if lawyer thinks it worthwhile, he of course has a selfish interest in the advise he is imparting- presupposing you will be paying him. Alternatively it might suggest that based on whatever information (or none whatsoever), your lawyer is lead to believe it is the former, that it is a detail the case handler might be willing to overlook.

The second and most important is whether or not it is economically feasible for you to venture $500 (plus or minus) on the possibility.

Not much help, but those are what seem to me to be the important contours in this ultimately personal decision.

You are right, you don't qualify, DACA rules stated June 15, 2007 arrival. Morally you should be since it's only 3 days but no immigration law is moral.

Despite all of this, I just advise you to go for it. 500 bucks is nothing.

It comes down to how you are going to prove that you were around those dates. When I applied, June 15 was not a specific date, b/c I used a school transcript. Dig up whatever you can, and try to use it to your advantage. You have to "build your case", the application itself is part of it.

465 is a low price for the benefits DACA grants and is well worth the risk
