I have a complicated situation just like all of you...but I hope I can find someone here with a similar experience.

I went to Canada back in 2005 with a visitor's visa and went into U.S. illegally in 2007. I got my DACA status and have been working since 2014. I was recently married to a Canadian citizen. She was here on a visitor visa so that we could get married. When she went back to renew her visitor visa right before our honeymoon, they denied her from coming in because she was poor in Canada...no family, no properties, no job, just a citizen. Now she's pregnant stranded in Canada. When she got rejected by the U.S., they told her that she won't be able to leave Canada until she's established with a job or buy a house. They said in order for her to go anywhere, she needs to prove that she has a strong tie and will return to Canada..But she couldn't prove this since I'm her only tie.

We are doing everything we can now to be together. I have thought about 2 ways...

1. I can apply to be a PR through her, but here's the problem..Will the Canadian gov be real strict and deny my application because I have a DACA status? Since I overstayed in Canada from 2005 to 2007 and up to this day there's no exit record of me leaving Canada...Will this cause trouble of me entering into Canada again as a visitor? PS: I'm a HK citizen.

2. My work agreed to give me a letter and let me work in Vancouver, BC, if I apply for advance parole and work there 6 month, until the baby's born, and in the mean time apply for Canada PR and forsake my DACA status and work. I have the same problem with question 1.

Any Answers....Advice...?

My advice is to seek out a lawyer familiar with Canadian Immigration Laws. The Canadian government isn't going to stricter because of DACA status. I'd be more concerned about overstaying your visa in Canada. Though maybe they aren't as unforgiving about visa overstay in Canada? That's why it's best to speak to a lawyer so you can make a well informed decision.

But the Canadian govt have no way to find out whether I overstayed or not, would that matter?
