Advance Parole for Travel after DACA Expiration

Hello all,

So I'm planning on traveling in December to visit an ailing grandparent. I submitted my AP application last week, but my concern is that my DACA expires on September 28th. Anyone have a similar situation? Will they approve it, or will they hold it until my DACA gets renewed?

Just to add, what I did is I mentioned that in my application, and included a copy of the biometrics notice and any other documentation I've received from the USCIS regarding my renewal application.

Any input will be greatly appreciated.

I am only guessing, but I don't believe they can approve AP without an approved DACA case. AP is based on the current status you have at the time. If it doesn't exist, then it is reasonable to believe that AP cannot also.

I agree with Ianus. You cannot return to the country without current DACA status.

"DACA applicants may not travel outside the United States until after their DACA request has been approved.

My EAD expires in October , applied for renewal in May waiting on approval but I also applied for Advance Parole for November. I asked several people and they said as long as you have DACA you can apply for AP. I don't know what's going to happen to be honest . they may denied due to the fact that they haven't approved my EAD but I guess I will just have to wait. I mean when they check my AP application , obviously they will see that I already applied for my EAD renewal so I don't see why they can denied. Let's hope for the best

Yeah I'm not sure if there's a precedent for a situation such as ours. I was hoping maybe someone had gone through something similar but it doesn't like it.

They'll probably wait until your DACA is renewed to give you AP. They may even send your AP at the same time as your renewal
