Breaking: DC federal judge says rescission of DACA still unlawful, despite new purported justification

They have no solid argument. We are all deep inside the system. I don't think they're gonna pull the rug underneath us like that.

Apparently he gave the government 20 days to appear. So his order is stayed for now. No new apps. O AP. I wouldn't pop champagne just yet

And what are they going to do with 20 days? They're not going suddenly come up with a good argument to cancel DACA. I think they know it's a losing battle at this point.

That's one way to think about it. Or they could get something called the Justice Department to come up with another legal argument. In his order (if you read it), he's saying he doesn't argue that DHS can't cancel DACA. They just need a good reason. If DOJ or DHS mentions that Obama oversteppes his bounds, that could be an inroad. I wouldn't count my chickens or work permits until they hatch.

Hopefully, this further weakens whatever adverse decision Judge Hanen issues.
