Good afternoon guys,

I am trying to help my dad refinance his house, he is on unemployment so that is why I would go on as co borrower or if I could take over the payments.
He is a Permanent resident and the reason we are trying to refinance is because is current loan is 8%.

Current loan is with TCF bank and we tried refinancing through them and got denied because im on DACA

Any banks you guys recommend?

I'm refinancing right now. My current loan is with Wells Fargo (It was transferred to WF but had initially gotten it through this company called William Raveis). What I can tell you 100% is that they CAN'T deny you because you have DACA. I'm currently going through this company affiliated with my credit union but I've also reached out and gotten scenarios from other mortgage lending companies that you hear about like Kwik etc. They can't deny you because of DACA.

So you are refinancing with wells fargo?
What should I do then since TCF will not move forward with the loan, we paid for the appraisal initially when my dad was going to do it by himself but his income was not enough so they told me if I could be on the loan and I said yes. I did not disclose my status until I got all the paper work to sign and it was pre-checked that I was a USC and I told them I was not a USC or permanent resident and disclosed my status so I changed it to not USC and not permanent Resident.

Not with Wells Fargo, different mortgage company. You need to press them and ask them why they're denying you based on DACA. Nobody ever told me anything about that and I've gone through many different places in search of my refinance. Worse comes to worse you should be strict with them and threaten to sue for discrimination.

Also be VERY careful with declarying yourself as USC (even by mistake), that is a major problem if it goes through on record that you're a USC. You should double check very carefuly so that doesn't happen again.

What i recommend for now is ask them for clarification on why they are denying you and if they need any further information...they might ask you a little about the EAD, you tell them that it is renewed indefinitely for 2 years (This is what I did when I got my initial loan). The bottom line is having DACA has got nothing to do with getting refinance/mortgage loan. You have a work permit and you're lawfully present, end of story. Tell them that exactly.
