Per GAO, the original sin was the appointment of Kevin McAleenan after Kirstjen Nielsen resigned. McAleenan was ineligible to succeed her.

McAleenan then altered the order of succession to provide for Wolf and Cuccinelli to take on their roles.

Well, this is a huge deal. We were in court, only yesterday, on our challenge to the new Wolf memo gutting the #DACA program. And, yes, part of that challenge was that Wolf lacks the authority to issue this memo. #homeishere
