I-130 wait time

So my LPR mother sponsored me back in April 2020 and filed the form I130 and every time i check there has been no updates to the case. When she filed we got a receipt notice and so far nothing. I know USCIS is backed up but is this normal because I've been stuck in receipt purgatory hell for almost 3 years.

Your priority date won't be current until 2027 at the earliest. USCIS actually sits on these long backlogged family applications to let any possible kids tag along.

So relax, it's slow for a good reason, and not like trying to push it through will benefit you any.

I have a Dec. 2016 priority date with my LPR father, and just this past August I was able to file my I-485. The final action date for F2B has now been stuck for almost two years. You've got a long wait ahead of you. I have not received my EAD through my AOS yet.

One last question. My LPR mother is going to file to become a citizen this year (5 years is up) when that comes through would that change my category or escalate my wait time in any way?

I believe it is your choice. You can either stay under the F2B or change categories. You just let them know at the time of filing the I-485.

I'm not Mexican, from the Caribbean. I guess what I'm asking is since my mother will become a citizen, when that happens, can i immediately change my category to first priority of immediate relative which would change my priority date.

Below is the date they are processing for March.. Right now you are Category F2B (adult children of GC holder) while F1 is adult children of US citizen. There's a 9month difference. It's up to you if you want to upgrade your category. https://travel.state.gov/content/tra...arch-2023.html

Thanks for the info! If I change my category to F1, will I still have to have the consular interview in my home country or can I do it in the U.S?

I think overstay is only forgiven for immediate relative (spouse/parent/minor child) with legal entry. Check with a lawyer if you still need a 601a waiver (it's another 2-3 yr wait for approval as of the moment).
