My friend an illegal immigrant was caught for petty theft of $30 sweater. And she will be going to community court for desk appearance. Will she get deported? if so is it on the spot?

What state is she in?

No, a regular court can't "deport' someone on the spot. However her case could be referred to ICE without her knowing of it...

I dont think so i know someone that did the same thing and she just got community service and a fine I think but no deportation this was in CA. I don't know about other states.

Wow. I am sorry, but it's people like her that ruin our image and is making it harder for all the hard working people. If she gets deported, she had it coming.

I live in NYC, and i've had friends detained and never got deported. they were either drunk, high, vandalizing things or arguing with cops. Tell her to keep cool and not disclose her status at all. hopefully she has a passport from her consulate w. no stamps at all. It's always better than a matricula, etc. to not raise suspicions. I hope she takes it easy. i know it's a tough and scary situation.

She'll probably get a misdemeanor, especially if it is her first offense.

Most likely, community service along with a fine.

Thank you for the responds. Anymore people know anyone convicted a crime recently and didn't get deported on court appearance?

I heard of someone who was undocumented and was only given a fine and community service. The judge will just ask you questions, such as how your grades are. If you have been in any other sort of trouble w/ the law. Stuff like that, to asses your character.
