My family entered the US without inspection when I was only 2 years old in 1990.

my situation is getting progressively worse (no job, no money, life is basically falling apart right now) and I'm considering leaving to my home country even tho I consider myself American. My BF & I have considered marriage but it seems like even if I got married, having entered w/o inspection, I would still be ineligible for legal residency unless I moved back for 10 years. Would I even quality for the Dream Act? Am I better off just leaving now?

I believe you would qualify for the DREAM Act if you finish high school and go to college or the military for two years.

I am not so sure you would qualify for legal status by getting married to a US citizen. I am not positive, but I believe you would have needed to enter the US with a visa and overstayed it in order to be able to marry a citizen and get legal status.

If you moved back, what would happen to your relationship with your boyfriend? Sure, that's an option. A lot of us here have our lives falling apart, but we're waiting a bit more. It depends how old you are. If you're going into your mid-or-late-twenties, then it's a tough life to live as your friends travel, get cars, get professional jobs, move out of their parents' place, etc. and you're stuck behind. If you're younger, you should wait another year or so.

Get a lawyer to see what your options are.
I think you would quailfy for DREAM Act and/or CIR.

you do quality for the DREAM ACT. why go back to your country when your parents risk everything to bring you here.all you have to do is wait. you can still marry your bf and be qualify for legal residence even if you came here without inspection. its a longer process...make sure you marry him because you guys are in love and not for the paper. good luck

It is not only a longer process,but the OP would also have to leave the country voluntarily during part of the process.

This is why 245i grandfathering is such a powerful option for an EWI seeking permanent immigration benefits.

It is funny,but most persons here actually seek out US citizens to *fix* their status here in the US,but in theory that only truly applies to those whom are visa overstays in the undocumented category.In theory,The most powerful type of petitioner for those who Entered-without-inspection are actually......................other undocumented.

The reason for this is those who have pending immigration benefits that are covered under 245i can also legalize the status of an EWI IN the country......... if married.
