I was wondering because i drive and evertything, but lets say if i was pulled over by a sherriff what would happen? I only have my college id and consular card. What if he detained me because he suspected i was illegal and i was to fight to fight the case ? would i be in jail ? how long? would i get residency ? i entered the United States when i was about 3 years old with Visa, but visited Mexico very often last time i visited was in 2005 almost five years ago thats when my visa expired

Franko, optimistically speaking I would assume the worst.

They can suspect you if they want.

If they suspect you, they will ask you if you are born in the US or if you are here legally.

If you lie, you are screwed, if you tell the truth, you are screwed.

Is there a way for you to move out of AZ?

If you got detained and reported to ICE, do expect to get detained (this can be between 3 days or weeks, depending on the situation) in jail or a detention center. Thereafter, you would be put in removal proceedings and appear in court. You would not be able to win your case unless you have proof you can stay through legal means (i.e. a bona fide marriage or that your parents happen to be US citizens which I assume they don't).

In terms of the cases that we have all seen of Dream Act students in proceedings, most were able to get their cases deferred, which means that their deportation orders have been cancelled but are still undocumented in the country until they are able to get legal status (via DREAM in the future, for example). Deferred action lasts for a year and one could potentially try to renew it once it ends. Not sure how common this is, though.

I thought they were considered immediate relatives? Now not so sure...

Abaddon is right they are considered immediate relatives.....but the issue here is immediate visa numbers being available to stop deportations not necessarily relation.

However, due to adult citizens having to wait such a long time for visa numbers it wouldn't stop a deportation/removal order as a visa number wouldn't be immediately available. Thus is why US citizen spouses and US citizen parents of children under 21 whom are in removal proceedings can usually have an application adjudicated in front of an immigration judge through proceedings.

Ok so i went to go see a lawyer today to ask him about this and this is exactly what he told me ^^^. The only way to stay here legally is if my parents were ctizens, if i am married to a citizen, or if i had kids that were born here. Which I dont !!!!!!!!!!!!!!!! But how come ive heard of many cases where someone in a similar situation like me gets a permit or something like that ????
