Ok so the new dream act excludes dreamers with final orders of deportation unless they remain under the color of law or it was before they were 16. My question is.... is appealing your deportation case and a motion to reopen 2 different things? and if you make a motion to reopen can you then apply for the dream act? or no because the order was there to begin with?
hey, im in the same boat as you. I got final order of removal in 2005. I have appealing my case ever since through BIA and the Federal Court of Appeals. When it says "under the color of law", it means that after you got the order; that you haven't just went into hiding.. you will still qualify for DA when you follow through with appeals, etc.
Basically, you cant be a fugitive.
Cause there is some people that get final orders and never follow up on them; they just ignore it.
