Battery on a peace officer and felony assault with a deadly weapon charge

A friend of mine got pressed with those charges after he and a crowd got in a fight with cops at a party that was being held in a park. People who were there told me that the cops were using excessive force The police officer who wrote the statement wrote that that my friend tried to take away his gun. How long will those charges put you in jail for? Are we talking about months or years?

For the first one, in Nevada it's a year in jail http://www.shouselaw.com/nevada/battery-po.html . It'd be more in other states I think.

For the assault with deadly weapon he's looking at 1-6 years in jail http://www.shouselaw.com/nevada/assa...ly-weapon.html

So all in all, he's looking to bunk with bubba for 7 years, or maybe half - I'm just a guy on the internet. If he's undocumented then that's the end of him. Either way, you'd be better off not having friends like that because all it takes is to be around them while they do something stupid and you'll be caught in the net too fair or unfair.

With the excessive force, good luck with that. Society tends to side with the cops.

Late 40's Dreamer (Holy Fucking shit I'm almost 50 and still dealing with this), aged out of original DACA and didn't have a chance to apply for extended DACA after Republicans killed it on the vine.

Thanks for the info. You know I actually had my wisdom teeth removed the day of the party so thats why I stayed in. He was DACA eligible but he never got it. I guess its over for him. He wasnt a bad person though; who knows what really happened the day of the party.

It's really hard to know what happened exactly as I'm sure he's embarrassed and doesn't want to be judged by his friends. One of my many jobs was around the nightlife industry and I saw people who may have been perfectly rational and reasonable during the day completely lose their heads after a few drinks (or snorts), being around girls, and being other drunks.

I can easily see fox news and the daily caller jumping on this one if he did have DACA. Headline would read something like:

"One of Obamas illegal DACA babies assaults patriotic American police officer"
