Hope and frustration seemed to be the mood of Congressional Hispanics who had come to the White House on Tuesday for a meeting on immigration with President Obama and his top aides.

Rep. Luis Gutierrez, chair of the Democratic Caucus Immigration Task Force, said that he emerged from the meeting “hopeful” but that the assembled members pressured Obama to use his executive authority to unilaterally bring relief to law-abiding immigrant families—especially children who would qualify for citizenship under the DREAM Act—even as the administration prosecutes and deports criminals.

“We made clear to the President of the United States that we believe he has broad authority to grant relief to DREAM kids,” Gutierrez told reporters. “We believe he has authority to do the same for American citizen children.”

Gutierrez said that the administration has been aggressive about deporting criminals and law breakers, but has not used the same vigor to assist undocumented children who are seeking to attend college or join the armed forces.

Look the focus … the president wants to make our community safer, we get that. We just think there’s a disconnect between his policies, his stated goals, and the actual outcomes … and we want to bring those into more compliance,” Gutierrez said. “That is the focus of the administration when it comes to immigration reform: It’s been enforcement, enforcement, enforcement.”

The administration has long pushed for a legislative solution to the country’s immigration problem, through comprehensive immigration reform and by passing the DREAM Act. In meetings over the last three weeks, they have sought to reinforce their commitment to those efforts.

But for the members of Congress invited to this latest meeting, there is more the administration can and should be doing. Gutierrez said they would leave it to Obama to be specific about what he was willing to do, independent of Congressional action, on immigration reform.

“What the president said was look, I have limited resources, I want to go after the criminals,” Gutierrez recalled, but he added that “the administration has powers and we’re hoping that they use them.

Gutierrez (D-IL-4) and other Members of the Congressional Hispanic Caucus (CHC) met with President Obama at the White House today to reiterate their call for the President to use the administrative powers he has under existing law to provide relief to certain groups of immigrants facing deportation. In particular, the CHC asked the President to prevent the deportation of immigrants who would be eligible for the DREAM Act and for their families, the family members of U.S. citizens, and other immigrants whose deportation is not in the national interest. "It was a productive meeting and there is no longer a debate over whether the President has broad discretionary powers when it comes to deportations," the Congressman said after the meeting. "The question is how broad and how generous the President chooses to be. The meeting was not about granting legal status to the 12 million or so undocumented immigrants, but rather how to prioritize deporting drug dealers and gangsters, but not to deport DREAM Act students and the families of U.S. citizens."
The Congressman pointed to a legal memo (http://bit.ly/kCVcxg) written last week by two former General Counsels to the federal immigration service and other legal experts that indicates the President has wide discretion under current law to provide relief from deportation -- at least temporarily -- for some immigrants and to remove barriers that prevent others from getting legal status in this country. The Congressman prepared a similar memo for the President in February and Members of the Congressional Hispanic Caucus signed a letter to the President earlier this year requesting that he exercise these administrative powers.
