Hello, I just joined this forum and I have a very important question...

I was brought here when I was 15 by my parents with the assumption that I was coming here legally and was going to get a better education, it wasn't like that. The visa we had was a tourist visa and I wanted to apply to the dream act, I was really happy but the bill says, "...lived in the country continuously for at least five years prior to the bill's enactment." I've been living in the (Maryland) US since October 2008 (3 years)... Does this mean I'm not eligible to apply? This really depressed me and I've been looking into it for a day now... Please, any kind of help is appreciated.

There's a difference between the State level Dream Act and the Federal Dream Act.The federal level DREAM Act provides us DREAMer's with pathway to staying in this country permanently(eventually becoming US citizens).The State level Dream Act have always been to allow us Undocumented DREAMer's to attend College while paying In state tuition rates.


The Maryland Dream Act is not law...yet

If you are still under 18, your overstay is not counted, so leave NOW and come back legally.

I wish I knew that before it was too late...

I'm turning 18 next month tho... Are you sure it's not counted? How would I be able to come legally? Won't they count it when I leave the country?

carniover if i were a mod, i would ban u for given bad advice
Samgon i think you should stay and pray that dream act is not passed for the next 2 years beucase
you only been in u.s for 3 years. dream act requires u to be in u.s. for 5 years.

u could get married too become legal

Would leaving the country be another option? What could I do back there?

How is it bad advice to tell her to leave and come back legally while she's still a minor?

However, once you turn 18, you start to accrue presence. By 180 after your eighteenth birthday, you will have acquired a three year ban from the country, which will be initiated once you leave the U.S. Once you have accrued one year of unlawful presence, that will become a ten year ban. If you leave the country while you have the three year ban and attempt to enter within three years, the ban will become a ten year one. If you leave the country with the ten year ban and attempt to enter within ten years, that will become a permanent ban and will not be waivable until you have been outside of the country for ten years.
