DACA, now Green Card

Hi to everyone, if any one has been in this situation or know anybody or can give me advice i appreciated..here's my story.

I just renew DACA and it expires in 2016, I am in a same-sex marriage been married since octuber 2014, we recently went to a lawyer to start my paper work for green card, my spouse is a US citizen i came here in 1996 with visa and i have my i-94,
The lawyer we talked to mention that there might be a small chance of me having trouble with my application the reason is because:
came here in 1996, i was 8 yrs old
travel to mexico like 3 times from 1996-2002 with valid visa
2002 was my last entry which i have proof since i have the i-94 i was 14 yrs old,

Lawyer said that since i was already living in the USA and left the country that could be consider "Visa Fraud"
He said they MIGHT ask me for a waiver, which is that i would have to leave the country and of course i don't want to go thru that process, he also mention i could wait for May since they are changing the rules for the waiver.
I'm just confuse because for the green card application i believe it only ask for the 5 past yrs of residence,
I know that for DACA i had to put down all my addresses since 1996
That's why the lawyer said they might open my DACA profile and see that
So i dont know how is it that they will even know i was here since 1996
I don't know what to do because now I'm scared to apply.

I would talk with another lawyer. What you mention is almost never a problem, there are people who have done that.

Do you still have the I-94 from your first entry? I'm thinking that if you present that instead of the one from 2002, then USCIS would consider that date as your date of entry for your green card app.

.... There are many ways to show that you didn't commit visa fraud and a lawyer should be able to protect you from that if it ever shows up. Which is why I would talk with another lawyer because they shouldn't be naive enough to even put you into that situation.... Get a second opinion,

Yes i still have my first i-94 from 1996 but since in my daca application i submitted my last i-94 entry, i figure i would used the same one, i ask the lawyer if i could use the 1996 he said then they might ask why for daca i used my 2002...

I will go to another lawyer for a second opinion hopefully everything works out

There is seriously no such thing as visa fraud if you're a minor. If you'd entered under a different name, then you'd need a misrepresentation waiver.

If the CBP allowed you back into US legally then that's that. Last entry counts. If they screwed up, it's not your fault or problem.

Use the most recent I-94 for your I-485 and don't worry.

If you were to overstay, and then re-enter illegally then you could be subject to a permanent bar. In this case, you're fine.

Get another attorney, that dude either does not want to do business with you by giving you stupid information or he/she does not have a lot of experience. If you browse the forum a bit youll find some post where i have pretty much given step by step instructions on how to file the AOS. If you want to do it on your own feel free to message me ill gladly help you. I do this process pretty much every day.

Well i am going to talk to another lawyer,
So it wont affect me the fact that i came here in 1996 and left couple times with my valid visa?
