Debt collectors and court order.

Hi guys...

I have a question that may not have been asked before, but if anyone is, or knows someone of the same situation, please help me out.

Here's the case:
A friend of mine who is an overstay is battling debts from the accounts he had acquired before his visa expired--all of which are legit. He has spoken to debt relief agencies to help him because, as we know, in our status, filing for bankruptcy is almost not an option. The problem is that one of them had filed garnishment order thru the court and he is trying to fight it because he has records of paying them off, but they claim that they haven't received payment......debt collector's are tricky like that....so they went ahead and held about $2000 from his bank account. Anyway, he has filed a court order to appeal his case, but the question remains whether or not his status will be questioned.

Does anyone know if his status will be a problem?
The case is not immigration relevant but is a concern nonetheless.

Please help!

Well.. I know this wont really give you immediate assistance but I strongly advice having him see a bankruptcy/immigration attorney. Personally I don't know much about this case and issue but it sounds complicated. I do know that as consumers, we have rights and no debt collection agency can violate those. If your friend is not fully aware of his rights, an attorney will surely help him.

His immigration status is irrelevant. Having incurred debts and now having debt collectors after him isn't affected by/or will affect his status (as in, he won't be deported because of debt if that is what you're asking).

OK great...yeah that's exactly what I was wondering. I know to appear in the court for garnishment does not require a lawyer, but I'll let him know to get one.
