DACA while in Removal Proceedings Thread

Since in this forum I can only find threads about people who have never been in removal proceedings or people with final orders, I am going to start a new thread here for people's experience and sharing about their daca process while their cases are still pending, like in what stage are their proceedings while daca is approved/pending and what did they do to their court case while their daca was still pending or approved. I can hardly find any info about daca while in removal proceedings online, far less than even final order cases.

My info regarding my case was posted in this thread, my case was closed after an individual hearing this week:

This post is for people who applied for daca while they had pending removal proceedings cases, not for people with final order of deportation cases, which should go to this thread instead: http://dreamact.info/forum/showthread.php?t=31553.

Here is the admin closure order that I got from my final hearing while daca is still pending, I have yet to see how daca approval notice look like

Looks like this thread applies to me. I was stopped by a police officer in Fountain Valley, CA, and taken in for finger prints. It was dark, late, and I was pulling out of a Norms when my eyes missed the 6 inch tall center divider, as I tried turning left. It took me maybe 2 seconds to correct my mistake, but the oncoming vehicle happened to be that cop car. I didn't submit my forms until the beginning of November. My lawyer postponed my hearing to July of 2013, from last month. The plan is to attempt to administratively close my case after USCIS makes a decision.

I also submitted my daca in November right after Obama got elected. My lawyer was able to close my case during my last individual hearing while my daca was still pending, but I think he didn't just base it on daca, but also based on prosecutorial discretion as well, saying that I was a good student and I am currently working in a high job position, etc.

Also can your lawyer request termination of proceedings instead of admin closure for you? Because the admin closure is something more temporary and they seem to be able to ask you to go back to court any time in the future, as written in the picture of the order in the second post.

I second this advice. I would try for a termination rather than admin. Close because once you adjust status you will have to motion to reopen.

Yes I have lately we also use them for people who aos while in proceeding so as to allow them to continue with the process with uscis rather than the EOIR. This may also be something to look into for someone doing stateside consular process move to terminate once I-130 is approve with Nvc fee paid. Dhs should be able to agree but then again this will be a case by case deal. Everyone ends up in removl for different reasons

Did you terminate it based on daca or something else?
