Can illegal immigrants declare bankruptcy??

A couple of months ago I had a nasty fall and broke two of my fingers which required surgery. I am up to my ass in debt, and wondering If I can declare bankruptcy. If any ones knows any other option for me I would really appreciate the help.

Yes, you can. Federal bankruptcy law has no provision requiring citizenship or residency. The only requirement is that a person be a "debtor". Assuming that you have had a domicile in Nevada for over two years immediately prior to filing the petition, you would be subject to NV state laws regarding exemptions and such.

Bear in mind most states will require you to provide proof of identity and proof of SSN (or ITIN) in the 341 meeting. Do not use a false SSN on the petition. This will land you in jail. Aside from the legal trouble, you most likely will not be able to discharge any debts incurred using a false SSN.

Be prepared for a long and daunting process. There's a tremendous amount of paperwork needed in a bankruptcy proceeding.

Really, the only way I see this affecting your immigration status is if you disclose anything in your bankruptcy filing that relates to crimes of "moral turpitude". That *may* raise some red flags down the line if/when you adjust your legal status.

Have you try to negotiate with the hospital with reduce your medical bill? Sometime the hospital will reduce your bill to a fraction of you original bill if you can prove that you can't afford it.
