Hi, I've been approved for DACA and I recently got accepted into one of the schools in NYC. However, they emailed me basically saying I need a I-20 form to fill out (F-1) student visa in order to study there. I have been here for 10 years, I have work authorization as well my social and stuff. What should I tell them ? they've been asking me whether i am a resident or not ? the community college I am graduating from now considered me a regular instate student (not an international).

Please help, any suggestions would be appreciated!

If SUNY or CUNY, tell them you are a NYS resident.

If private, tell them you are a NYS resident and you do not require an F-1 visa.

I am unfortunately from MA and I am a transfer student. the school is under the SUNY as well.
I told them I'm under DACA and they still kept asking me if I am a resident or not... so I'm planning on meeting them next week and explain in person.
what should I say/explain to them?

Oh i see. Thats why its complicated. If you are from NY and have gone to HS in NY, SUNY policy states that whether you are a citizen or undocumented you MUST get instate tuition. Since you are an MA resident, you are not eligible for NY residency. What you should do is talk to the suny office next week. Tell them you have deferred action, which gives you a work permit.

Ask them if you can pay Out of state tuition for the first year and then pay instate there after. This is assuming you can become a NYS resident.

Im not worrried much about the out of state tuition because I know after one year I become a resident of nyc. However im just worried on what to tell them... That I'm just lawfully protected under DACA?!
They cannot let me study because i dont have a f21 visa... And i am not considered an international student at all. They are legit stressing me out haha

It is a bit of tricky situation, but if it's a CUNY or SUNY school you should be able to explain to them your situation honestly, and I think they'll be familiar with it. There's an organization in NYC that I know helps undocumented students with getting into college in NYS, maybe you could contact them & they should be able to offer more help about your case specifically.
