i came to this country 1998, when i was 13 years old.
my aunt filed for green card in 2001 for my dad
the bulletin board is updated to 1997 and the way it's processing, we would have to wait a couple more years
i am now 22yrs old
when we finally get the green card, would i be eligible?
i'm over age after all
please relieve my worry

i think there is a law that helps kids from aging out..i forgot the name..but as long as it was filed for you before you turned 21 you are good, i believe.

OKay, i reread it and it says it was filed for you dad?!? only your dad? were you listed as a beneficiary?

i thought that was 18.. i was talking to somebody about this earlier and they told me that once you're 18, you're an adult

once you are 18 you start accruing the unlawful presence..but you age out after 21.. meaning you are not able to benefit as a beneficiary of your parents

The law that protects children from "aging out" is called the Child Status Protection Act. It was passed recently. Google it and see how it helps you.

To my knowledge, you're only protected if you filed a petition with the INS before turning 21 or if someone else filed a petition on your behalf before you turned 21 or if you're listed as a beneficiary on someone's petition that was filed before you turn 21.

If not, then I'm sorry but you're not eligible for any benefits.

Unless you just turned 22...I don't know, I really doubt that new age out protection law applies retroactively. If it did, a lot of people here wouldn't be in this situation. You should give it a look, though, just in case.

Under the current version of the Dream Act, you would be eligible now. Once you get the green card...um, no. Why would you want to be? In its current version, Dream gives a conditional green card, so you would be going backwards. And future versions wil probably give even less. If you have a green card, you're good, you're done. Benefiting under dream would only put you further away from citizenship.

i just asked my mom, and she said when my aunt filed for it
she put all our names and info
that's one of the reason she didn't want to apply for us, there's just too many of us
so, i guess i do qualify
i thought she only filed for my dad because all the papers we recieved had my dad's name on it
but all are info are in there, so it's cool
it's another long wait tho'
thanks guys
and i'm still fighting for dream
we deserve it

I hate to be the bearer of bad news, but I don't think you qualify. My dad filed in 1996 under 245(i) and thought the application was denied due to a dumbass lawyer. Turns out in 2005, we found out the application, which listed my sisters and me as beneficiaries, had been approved since 1998. My parents now have their work permits, but our new lawyer said that we, the children, had aged out already. I'm 26.

i am so confused,
i read the child protection law and there's this weird formula and i am not totally sure if i qualify
the thing is, i see alot of people who age out, basically in my condition, but they still get their green card,
i want to talk to a lawyer, but i wonder how much it would cost,
know any good lawyer?
