I just wanted to clear up on the subject, I looked around the forum and i could not find an answer to my question.
Once approved for DACA, will we be able to pay in-state tuition?
I know sometimes it depends on the college and the state. I am just curious if the work permit and SSN will be enough.

Those state give undocumented students in state. He's asking if he will be eligible for in state in his state ( which probably bars undocumented students) after DACA..

The answer is that it depends entirely one your state. Some states have come out and said they will give in state tuition some not, but might.

I was reading around the other day about this for California universities. It seems their policy allows TPS beneficiaries to qualify for in-state tuition. Now, it's true that USCIS makes it very clear that DACA does not give one legal status, but seeing that the DACA benefit is pretty much a variation on TPS, I would not be surprised to see legislature in the near feature allowing in-state tuition for those who qualify for DACA as well, in CA and perhaps the more liberal states.

But, for now, yes -- you're dependent on what your state currently allows, a few of which states allow those who attended high school a certain number of years in that state to qualify for in-state tuition.

In California
For Drivers licence: DACA somewhat legal status so granted DL
For in-state tuition for undocumented: no legal status so qualify for sb540
Only DREAMERs can get away with this

OP,You basically answered your own question there is no logical and conclusive answer considering the variations amongst educational institutions and vary state laws.

That's a good question. I live in a state that's not in the list. This would be great to know when I transfer to a 4yr. I'm sure there will be others interested in knowing, as well.

You guys have to find out a way to get in-state tuition. I live in a State that is very conservative and does not give in-state tuition to people that are not here legally, buy I figured out a way around it. I posted this elsewhere, maybe you can do a similar thing where you live?

Quote:
Idaho does not give in-state tuition, but I found out about a way to get through that restriction. Every college has an Affidavit of Residency available in their website, everyone has to submit that even if you were born here.

I filled mine out, let the SSN blank, and just simply stated that I have been residing in my county for 12 consecutive months. I sent it in, and it got rejected. They asked for proof (bills, tax returns, etc.) so I sent that, they sent it back with another rejection. So I talked to a teacher in my high school (I was doing College Credit in High School) and he recommended I go talk to the County judge. I took it to the County judge in the court, and she signed it without questions.

I used that same accepted Affidavit to get in-state tuition in the college that I'm currently attending. Maybe this only works in small counties?

this is what i got from Morris county college of NJ when i email them if they will still consider me as "undocumented" after DACA

"You can present your employment authorization card to the Admissions office so you are not considered an undocumented student. However, the only way to be able to pay in county tuition is to show us a permanent residency card. Hope this helps!"

i decided not to go since each credit is $347.50. ridiculous! so for now im just waiting for my application to be approved so i can get a better job to pay for school

this is their policy for Undocumented applicants on their site http://www.ccm.edu/admissions/apply/undocumented.aspx

Does anyone know any states or higher education institutions that are treating out of states students with DACA like they do any other out of state students that can apply for in-state tuition if they meet the state requirements?
