My dad petition for me back in 2007 as a us resident was approve 2009 i130, never heard anything after that im 24 now. He is a usc I applied for a daca back 07/25/2013 haven't been approve yet, my gf and I have been together since 2011 whats my best option for me to get a green card?

Wait for daca to get approve? Then married her ?
Wait for my i130 case to move forward?
Or just sit her depressed and eat and gain weight like I being doing?

The answer to which option is best, the answer is of course, talk to your lawyer.

My own random feelings are:

You're already waiting for DACA...Wait a little longer. It will completely change your life for the better.

Nothing says love like marrying your GF at a young age for a green card. She will feel very special and I'm sure she will not feel any resentment, get any second thoughts, or get advice from her friends and family that you're only marrying her to get a GC But that's your fastest option.

You're already waiting for the i130 too but that will take a few more years.

What girl wouldn't love to marry a depressed fatty who wants to marry her for her green card? Mix in a salad, hit the gym, and wait for DACA to kick in. It will make you feel better and your GF would be happier too.

A visa will not be available for you through the petition your dad filed for quite a long time if you are from either Mexico or Philippines. But according to the Visa Bulletin if you are from any other country they are now processing application filed in 01/2007. That being said if you came in with a visa you could be able to adjust. If you did not come with a visa you will not be able to do anything with it...unless you AP once you have daca.

In my opinion, you are better off waiting for your DACA to be approved and AP and then you can get married and file the adjustment.

Trust me I've been there so there are some sprinkles of truth in my humor too so just prepare yourself for some backlash from her friends and family too and make sure she knows you love her and that's the real reason you're marrying her (if you do).

Did you contacted USCIS to inform them about your dad becoming a USC?

Wait for DACA, you've waited a long time now, the waiting will be almost over soon!!! If you get denied or if you really want to get married, then you can get married.
