Hi Everyone,

I been reading posts on this forum for quite a while, but this is my first time writing. I applied for a Uvisa on March 9, 2012. I had my biometrics taken on June 15th. I am still waiting to hear from USCIS. I want to go back to school and apply to grad school. My applications are due the second week of December and I don't know what I should do. Should I just apply as an AB540 (I'm in California) or should I wait longer and apply next year?
I am also considering to apply for DACA since Uvisa is taking a while now. But I wonder if my Uvisa will get here sooner than DACA.
Any advise? Thank you!

I think you should absolutely hold off on applying for DACA if you've been waiting that long. There are currently visa numbers available for U visas and might just want to be patient with Vermont.

What you do according to school is up to you however, but I think you should be patient concerning your application for status.

Ianus, Thank you for your advice! I been playing the waiting game, but I sure won't hurt to wait a little longer.

Your welcome,The problem in Vermont is that they are the only Service Center that has jurisdiction with regards to the visa and the amount of individuals applying have been steadily increasing each year as well as the processing time for such applications.I believe the nominal application period is 10 months so you're still well within the processing timeline.

If you want to check up on your application there is a phone number where someone might be able to help.802-527-4888

But isn't there a quota of 10,000 per year? If you have been waiting that long might as well wait. However, if your applying to grad school for next fall 2013. I would apply or else you have to wait and apply for fall 2014 unless your program accepts spring entrance.

The application for CA Dream act starts on January and I believe ends somewhere in March next year, so if you are going to apply for AB540 better decide since you don't want to miss the deadline. For those months you will receive aid for Fall 2013 and Spring 2013.

Would I still qualify for the CA Dream act as a grad student?

Hi...my case is similar to urs...i applied for a UVisa on Oct/2012...i did my biometricsfor it on the 31 of Oct...on oct.17 i sent my Daca app. My attorney suggested i apply for daca even though i was applying for the visa, because the visa will take about 9-12 months to be approved and is uncertain when the work permit with that app will be approved that why i also applied for daca. Taking here!..but i guess it works fine..i might be approved for daca soon...so it wont matter how long the visa takes..in the mean time daca work permit will help me this spring to enroll into my CNA course...oh and i am currently a 540AB student at miracosta college...just apply for college Nd apply for the Daca...it wont hurt ur visa...besides u are not doing anything illegal!... good luck..and if u have an attorney they should know and agree with what i just said!...
