I have an issue hoping someone can help. My family and I moved to the us legally in '97 but we're unable to renew our e2 visas. I am applying for the deferred action program and I have to have valid identification to get my fingerprints taken. My drivers license is expired and so is my passport. I can't renew any of them because I'm not legal here. I live in Texas and the law states I have to show legal residency to apply or renew my dl.
If anyone can help me on what to do please let me know

Thank you

What is your country of citizenship? Most don't care that you're in US illegally when it comes to passport renewal.

Go to the consulate of your country and apply for new passport, more than likely you can obtain it the same day. If you have your expired passport is the easiest way for them to pull up your info and get you rolling fast than if you had your birth certificate because then they would need you to prove you're the person on there. I'm in Texas myself and i've done it in both Texas and California.

I am from the Netherlands. I have been in contact with the Dutch embassy and they told me I cannot renew my passport because my visa has expired.

Yes, Netherlands is on the stricter side when it comes to renewal. Did you try explaining the situation? Maybe you can show them a copy of the appointment to get fingerprinted from the USCIS?

If you already have an appointment time for biometrics i suggest you just dont show up, you should still go and present 1 or both of the expired documents you have. I mean, what do you have to lose? Rather than letting your application go abandoned. I have a feeling they wont even care. Good Luck!

First Application:
9/29/14 - NSC
10/22/14 - BIO
6/14/15 - RFE
8/6/15 - DENIED
(High school not accredited)

Second Application:
12.23.15 - WAC
1.25.16 - BIO
