Legal entry requirement.

As we all know, in order to do AOS, you must have a legal entry on record.
Does this mean that your last entry was a legal entry? I used to have a tourist visa in the past, but then it expired and my last entry was without inspection.

Do I meet that requirement?

you came here with a tourist visa, you overstayed, then you went back to your country, and came back here illegally?


your legal entry is always your last entry so your present entry would be EWI

Yes the last entry must've been legal. If you overstayed for 1 year or longer, left, and EWI'd then you have a permanent ban. There's only 2 ways around it:

1) Leave the country for 10 years and then file I-212.
2) Cancellation of Removal.

Yes, your last entry must've been legal. Also, for how long did you stay in the country after your tourist visa expired? You may have triggered the 3-10 year ban by overstaying your visit and then leaving.

Check with a lawyer.

3-10 ban isn't that bad since you can waive it. The permanent ban for being US illegally, leaving, and re-entering is an utter bitch since there is no waiver aside filing I-212 after being out of 10 for continuous years. COR can overcome it but COR is the second hardest immigration relief to pursue.

MARCO, what does 956 mean, YOU IN THE RGV!!!!

Anyways I entered with an old border corsser card and apparently that is all the proof I need for entry with inspection, DONT lose that card, expired or not it is your proof. Before the LASER visa.



If you left after the fact and came back then the question is does USCIS know?
