Is John McCain’s successor already in office? If not what does that mean for the floor vote on Friday?

the AZ governor picked Jon Kyl to replace him since Sept 5.

even if they were down one senator, the vote threshold goes down to 99.

simple majority needed.

republicans collins, murkowski, flake are on the fence.

but there are 5 red state democrats.

The vote Friday is only by Senate Judiciary Committee, not full Senate. If it goes forward today the final vote by full Senate will most likely be held next week.

Red state democrats will vote no if their votes matter. It doesn't really make a difference if this guy gets confirmed 50+VP - 50 or 56 to 44.
