Today, Acting Department of Homeland Security (DHS) Secretary Pekoske signed a memorandum directing DHS components, including Customs and Border Protection, Immigration and Customs Enforcement, and United States Citizenship and Immigration Services, to review and reset enforcement policies and set interim policies for civil enforcement while the Department develops its final priorities.

For 100 days, starting January 22, 2021, DHS will pause removals for certain noncitizens ordered deported to ensure we have a fair and effective immigration enforcement system focused on protecting national security, border security, and public safety.

The pause will allow DHS to ensure that its resources are dedicated to responding to the most pressing challenges that the United States faces, including immediate operational challenges at the southwest border in the midst of the most serious global public health crisis in a century.

Throughout this interim period DHS will continue to enforce our immigration laws.

I am certain Republican attorney generals will challenge this move in courts and take it all the way to the Supreme Court. And, with the conservative majority in the Supreme Court, it will be struck down. Only a legislative solution is a real and permanent one.

they kind of exhausted all of their options. Supreme Court did not strike down DACA and then SC said Trump can't phase out DACA out of the blue. Now Biden is in the WH he ain't phasing it out, so try again, but even the Hansen did not dare to suspend DACA protection while he was hearing all the DACA cases. They can try and we will keep issuing new EO.

No. That is not accurate as far as I know. The Supreme Court case was brought up by the Trump administration, not the Republican states, after legal challenges. As you probably know, the Supreme Court decision did not state the legality or illegality of the program itself. The decision was about how the Trump Administration ended the program without the existing proper review process. So, the states can challenge the Biden Administration’s decision and take it all the way to the Supreme Court. Justice Thomas stated that he thought it was illegal in his dissent if I remember correctly. So, if the states bring up a case based on the legality to the Supreme Court, it can be struck down (with the bigger conservative majority).

So, our only hope is a permanent solution.... that is... a legislative solution....

It was not brought to the supreme court bases on the legality of daca but on trumps ability to end it. The Texas case is different, they are questioning where daca is legal or not, a big difference to the supreme court and the way they make their decision. The SC did us a solid their by only looking at the very narrow question of trumps ability to end daca. The question of the legality of daca is a whole different issue and they would most likely rule that daca is illegal as a program.

Only congress has the power to help us permanently.
