Hi all

I'm getting errors posting a new thread. Here goes...

I'm a DACA recipient from 2012 as my signature states. Due to unforeseen circumstances in 2017, I traveled outside the US. My Advance Parole application was denied because I could not get the birth certificate of my estranged father on time. My DACA was renewed until Aug 2018. I think upon my departure DACA automatically ended. I am happy that I was able to see my father and help him through his disorder in the last 5 years. I am in Asia in my birth country.

I was wondering is there any route to renew my DACA status and get back to the US?
If I apply through the US consulate here, I am afraid I will get the black stamp for my overstay in the 2000's before DACA. My mother is still undocumented in the US.
I am starting research only recently and any legal help /attorney contact would be appreciated. I have tried my local legal help numbers and left voicemails but I don't have a US phone number to receive call backs.
Does anyone have similar experience? Please share. Thanks all

you are done for. no way to fix this, you got AP denied and still left, you basically self deported and probably even triggered a ban.

and to top it off you are not even in the US..... really bro.

Only routes I see for you are , getting your family in the US to renew daca for you , apply for AP as if you were still there and then have your family send you the AP document by mail and you fly back with that. But if they request your biometrics instead of using your old ones you’re cooked like shrimp fried rice.

Other route is entering without inspection and that’s almost impossible nowadays so don’t even try.

Other route is marrying us citizen but even that may be complicated due to overstaying your visa but that all depends on how much time you were there with unlawful presence (how much time you were in the US without daca and over 18 years).

Thanks for all the replies. I always appreciated this forum and support/info.
Third point - I was 8 years over 18 and without daca - will this complicate things even if I marry a US citizen ?

Yes that means you triggered an automatic 10 year ban unfortunately

there are bypasses for the ban, thats when you have to get a lawyer cause i think it depends on the country of origin.

You cannot comeback unless you had DACA AP approved and/or I-601A. You would trigger 3/10 year ban. What country in Asia? Were you a Overstay Visa? You can’t get DACA back. You can apply for non immigrant Visa unless you have a sponsor to do the consular processing or employer based Visa.

Thanks all for your replies. Do you know any attorney that will advise through email or over the phone?
