I came to the united states as a child when I was 4 years old. Since then I have lived in the United States till the age of 18. After my `8th birthday i returned to my home country. However, my dad is still in the united states waiting for amnesty (if it happens). I have just starting to learn that the drea, act is picking up momentum, and that it actually might be passed in the senate and congress as a stand alone bill. The terms are simple:

1. continuous presence in the united states for a min. time of 5 years

2. serve 2 years in the military or 2 years of college.

3. not be over 35 years old.

Since the bill is already written I am wondering if there is anyway that I can still be apart of the dream act. I feel its ridiculous that the united states would reject me on account of not being continuously in the united states. However, I never have been arrested, attended a private high school, and am currently attending a private university....and my dads papers for a greencard are 2/3 of the way done but the other 1/3 cant be completed because he overstayed and i245 has since expired. Is there anyway that my status can be revoked if the dream act is passed, and for me to get temporary residency? I need just 1 sentence that can will allow me to be qualified.

From what I heard you Must be in the U.S for five years prior to the passage of the bill if for some reason you are not then you are disqualify. No way around it unless they say its OK.

So where are you now? You have to be here for the past 5 years starting from an arbitrary date that the bill will set (like it's passage/signing), so if you're not in the US like right now .... it doesn't look good.

Not to sound harsh, but it doesn't matter if you're dad is here or not or if he's got paperwork pending or not. There are a lot of dreamers with legal parents/siblings. The DA is for you, not for them. The text of the bill does stipulate continuous presence and it's hard to overcome that if you've left.
