came here when i was 13 brought here from colombia applied for assylum but it ended up bad,too much negligence, i been trying to join the marine corps for bout 4 years now , but they obviously wont let me cause of my status...
hope this act passes so that one day ill be able to join the military, thats all i have ever wanted to do since i got here, but no luck so far , it wasnt my fault either to have the status that i have.
I qualify for this dream act , came here legaly, graduated from high school here and dont have a criminal record...

Did you get a removal order after your asylum case failed and if you did at what age?

If you got it before 16 or 17 (I forget) you still qualify for DREAM, if you got the removal order after, you don't under the most current version. But who knows what the newest version will look like, it might be 18.

If you have a removal order, you really can't adjust in the country unless DREAM passes and you were under 16 or 17 (look it up in the text of DREAM).

I hate to tell you this but you're technically a "fugitive alien". That means they are ACTIVELY looking for you. Most likely if they find you they will pick you up in the middle of the night put you in prison while they arrange your deportation. You cannot adjust in the country. Not even with CIR.

It's different if you don't have a removal order. You are first put into removal proceedings to determine if you are removalable or not and those last anywhere from a few months to a few years. However, you've already been though that and I'm guessing were granted voluntary departure. Because you did not follow it though, they are actively seeking you out.

The system is ridiculous. What were you supposed to do at age 16? Become a runway? How the hell could you have even come up with the airfare to fly back at that age without your parent's permission? The system is heartless and unfair but that's our reality.

My advice is to get an education and save money and then leave on your own accord. Who knows maybe the next version of DREAM will have a cut off of 18 but I wouldn't count on it.

The only thing I can think of is something along an I-601 wavier but I don't know how those would work with people with removal orders. Go ask over at the www.immigrate2us.net forum.

For those of you who don't know a removal order is something a judge hands out at the end of removal proceedings if they find the person can no longer stay here because they are no longer eligible.

Usually if you apply for asylum and it's denied you are put into removal proceedings and sometimes if a family member petition is denied (say you don't qualify (example, parent petition for a child over 21 without 245i or the sponsor dies or you get a divorce in the case of spouses or a million other things). We're not the oppostion and know there is a gray area on who is documented and who isn't. So just because someone is in removal proceedings that doesn't mean they atumocatically have bans. So talk to a lawyer!


I am not a lawyer! Talk to SEVERAL and do your own research because half of them know less than we do.

I guess if you have a removal order you can still adjust as long as you didn't get voluntary departure???
