When someone is deported he gets a 10 years ban and a petition will not work. Getting a waiver in this case is impossible, so the only way for him to enter the US is without inspection.

I'm sorry to hear you and your family are going through this.

I second Negrita's suggestion, try contacting some immigration org near you and leave your house for a few days. Sometimes ICE comes back to check the status of the other members of the household.

wow. i thought the penalty was still 5 years...my uncle got deported in (i want to say) september..? and he was only banned for 3 years and he has a criminal record.
hmm..maybe there was something different about him...
im still going to look for that article. we cannot allow future families to break up due to the american citizenship.

Im kinda scared because last year I was hanging out with friends and the cops came. They questioned why I didn't have any documents ,and asked me if I was illegal ,and I said yes because I didnt want to lie. The cop said he was gonna arrest me for being illegal and that he needed to take my name because they must keep track of all illegals. I hated that day because I was doing nothing. He then let me go because he said that I wasn't doing anything wrong etc. However, he did take a picture of me and my name.

it happened in cape coral Florida. Im contacting a immigration lawyer in Miami about it. Im legal here because of my mother. but its long complicated story. All in all he most likely will go back, but we always planned that something like this would happen so we saved a lot of money and bought condos and invested back in homeland. He is going back but in good condition. Its just that we arent going to see each other much. But hopefully one day he will come back to me

Thank you for everything guys.

But it depends, there are some Sheriff departments that report to ICE about every illegal alien they spot. There is a list of the county sheriff departments that particiapte in this program and you can check if your's is there on this list:
http://dreamactivist.org/2008/11/30/...participating/

This is not a new list, it's from few months ago and since then I'm sure that other join but look at that and if the police that questioned you are in this list then I'd move out to a different address (if they got your address), but that's just me.

My uncle told me that back in the 1986 amnesty, before the amnesty immigration raids hit hard everywhere trying to catch as many illegals as possible before granting the rest amnesty. Déjà vu?
