Unfortunately,We're going to have to wait until the bill actually passes to see how USCIS would interpret this particular section but I'm leaning more toward lu001's interpretation since it says...

(1) IN GENERAL.--An alien shall be considered to have failed to maintain continuous physical presence in the United States under subsection (a) if the alien has departed from the United States for any period in excess of 90 days or for any periods in the aggregate exceeding 180 days.
It doesn't say 5 years presence,specifically.Hopefully,I'm wrong though.

That's what stumped me, continuous presence vs. continuous five year presence. That is what you should watch as the bill evolves, who knows what will change. It also wouldn't be a bad idea to consult a lawyer.

omg!! i'm in the same boat as you came here at 12, started junior high, went on to high school, dropped out, left at the age of 16, came back and got my ged..been here ever since 8 yrs continuous and counting. I too am worried if I might have a problem for leaving!!

I think you already knew the answer when you came here and only wanted confirmation. In the version of the bill we know, you would qualify for Dream. Until it passes there will be many changes though, so hopefully nothing will be added that will hurt your chances of qualifying.

The questions is when the bill passes, what is the deadline to file it?

Are they going to give a 6 months, 1 year deadline?

Illinois Dreamers, help!!!

You can see that a lot of people including me, portoaereo, Sonawabich, and pink have a "a long break in presence before 2005" problem.

Immigration lawyers cannot answer this question, only the bill writer Dick Durbin or his aids could. So please forward this question to Dick Durbin if you are an Illinois resident.
