Hi all, new to the forums but been lurking for a while!

Quick question,

been here illegally for 10 years, planning to go back because just can't wait any more. Will there be any prob if i just go back to the country I came from? or do i need to explain anything at airport? Also, would i be able to come back legally or will i be banned? Thanks!

From my understanding if you leave you will be banned for 10 years and wont qualify for the dream act anymore. About going back well if your from Mexico you can simply just go back as they dont check( or so Ive been told dont know about this one for sure)

just want to know, if u enter illegally and then leave, will they apply the 10 yrs ban on u since there is no evidence that u have come at all.

The rules are the same for both overstays & EWI's because both are considered to be undocumented & are covered by the same rules.If you have unlawful presence for more than a year & leave you'd have a 10 year bar on re-entry & immigration benefits.If you leave & re-enter during when the 10 year bar is in effect it then becomes a permanent bar from the country & all immigration benefits.

You should be okay but you will have a 10 year ban.

My question is why would you want to go back now when we can almost taste the dream act? honestly, we're closer then ever. Stick it out just a little bit longer.

thanks for the replies everyone.

yeah i agree it's sooo close nw but I have been accepted into university in my home country (scotland) and need to choose between getting on with my life over there or sit and wait here.

So, just to make sure i understand, if i was to just get a one way ticket to scotland, how would anyone know that i was here in the first place and that i need to be banned? I was told by some immigration lawyer, that no one would know about it and i would be fine to come back for vacation and stuff and apply legally through my aunt.

it's sooo confusing. can't understand what to do, it's like i want to stay, but don't want to keep waiting and miss out my chance of going to school in scotland.

Scotland? Cool. We are so diverse lol.

Originally, when I wanted to leave I spoke to a member here and she said that they had her sign something at the airport. So they will know that you were here upon your departure to Scotland.

Is it possible to defer your start at University until Jan. 2010?

Unless you get out through Mexico (where you don't have to sign anything) and get on a plane from Mexico to Scotland.

But I don't think you'll be able to get back here. I mean, you would after the 10 year ban. I've been thinking about it too. I have 2 passports (citizenship), the one I came with is European and doesn't require a Visa, so I always thought about going back and then try to come here legally using the other passport, but it's way too risky, and I've waited way too long already..I can wait a little more.
