If you qualify for AB540, why don't you just change it? You could say it was an error in your application. Since you would pay the same amount of tuition anyway, there wouldn't be any problem.

In Texas law, if you lie on your application, then you can correct it, but you would have to pay back the amount in which you where suppose to pay. The university could punish you, but not exactly sure why they would since you are telling them about it... I made the mistake in 2006, but I am going to correct it in a few weeks, so I will tell you how it goes. I just don't want to take the chance.

Edit: Also in my case, I applied to college in 2005, and I didn't know I was undocumented at the time. Since I don't look undocumented, my adviser assumed that I was a citizen, and told me to mark it.

I went to college for 3 years and I put that I was a citizen because I did not qualify for AB540 and I was not about to pay out of state tuition. I married 2 years later and had to go to Juarez and they did not mention anything about my college application and I was able to get my residency.

I doubt that there is any type of connection between college applications and ICE. I think the only way they could get that information is if you were suspected of something and they knew that you were in college and went there to request more information about you.

Is this the SD Angel from CoSA?

I think lot of us have done something simliar, at one time or the other. Our excuses should be "we didn't know any better".... but I'm still curious to how it'll affect the adjustment interview. I wonder if they'll ask that at all, or will have the record in front of them, I doubt it though. I'll probably lawyer up just to be sure when it's time, I fubared an I-9 in college, it wasn't even the citizen part, I basically wrote in random numbers for the most of it O_o

lol, agreed. Hows post-husband's legalization life Tasksgirl?

And I also agree with her comment, I dont think USCIS Will check every or even have the capabilities to check EVERY single document we have filled out while living here. However if we are filing under the dream act they probably will want to check our college apps.

Nope, you will not be penalized, DREAM act does not care.
