Since I will be marrying a USC very soon. Once he has petitioned for me (I entered illegally), on an average how much time will pass by before I have a green card in my hands? He keeps freaking out and refuses to even accept the idea that I will have to go back and just wait for my waiver to be accepted. I know the overall process but what other information can you provide me with? What should I expect? I have an appointment with a lawyer scheduled but I can't stop thinking about this.

Thanks

I don't know the answer, but try going to immigrate2us.net cuz a lot of the people on there have time lines on their signatures stating how long they waited till they finally received a green card even if they entered illegally.

Hey.

Ok, well first you file I-130.. That's the easy part and is pretty much always approved. I think it takes around 3 months for that to get approved after you pay the fee and send in all the evidence.

Then, you have to set up an appointment, which is the initial visa appointment at the US consulate in whichever country you're from or filing from, in my case, Ciudad Jarez in Mexico. I think people usually get their appointment under a year after they filed their I-130.

You leave the US for your appointment. People usually go about a week prior so they can do their physical, etc. Since you entered illegaly, you will be denied the visa. There, they will tell you if you are eligible to file a the waiver.

Next, you set up a waiver appointment. From what I've seen from others, it's now at least a month before that appointment.
You go to that appointment with your Waiver, hardship letter, and evidence of hardship to your USC husband.
Then, I think sometimes they don't always tell you right away if you're approved or not. I've read that sometimes it will take like a week.

It seems like the timeline of most people is a little over a year from when they started the process.. maybe 1 yr 1/2. I guess it depends. But out of the US, people that are approved aren't out of the country for very long.

But, if you don't get your waiver approved because of lack of evidence, then they put you on a backlog list. You have to send them more evidence of hardship to your USC husband and wait for another appointment. I think that is the worst because people don't get their appointment til like at least a year later.. So yeah, they have to stay there.
You try again, and I think usually most people get approved unless their case is really complicated or they have criminal issues or the Entered Without Inspection more than once.

Like everyone else said, go to that website. It has soooo much info and lots of people willing to help you along the way.

this is not recommended...lol

although we don't have the papers, we still got the dignities like everyone else in this world. my point is unless it works out for someone, don't force yourself to do something you will regret later...
