So i've been kind of stalking this site for a few months now and i decided to share my story since i need a little advice from complete strangers.
I am stuck in what i hope is the worst time of my life. I am nineteen years old, wishing i could attend college, carless, family-less, paperless and last but not least, almost moneyless. I happen to live with my best friend's family because my parens moved to spain about a month ago. I have a great boyfriend/husband who goes to college 2 hours away but he's helping me by driving me to work as much as he can while it's summer. He's very supportive and wants what's best for me. I have a coworker who is offering to sell me his car for 2,000 dollars [of course i have no license]. And i have a job [thankfully] because my mom's friend pulled some strings for me. Oh and i am supporting myself completely because my parents can't give me money. How did i get here you ask?
I was born in peru and then moved here when i was 10. My mom got remarried and her husband decided that starting a family in the US would be exciting. Of course she wanted me to come along and having no idea what the hell i was getting into, i blindly followed my new family to a place i'd never heard of, North Carolina.
I went through middle school and high school just fine and then bam! my senior year of high school hit me and i realized i was screwed. My parents were illegal and so was i therefore i couldn't go to college. As i watched all my friends beginning their lifes by applying to all these schools i became a little depressed. I had no hopes of any kind of future. Scholarships suddently became out of the question as my grades dropped.
So, i decided to take a year off from school and work illegally at a store my mom's friend managed. My parents of course, had to drive me to work but everything was fine for a while. Until...
My stepfather decided it was time for a change. He decided that moving to another country would make life a lot easier. Since he has italian citizenship, he was able to move my family to Spain. Well my whole family except me. Of course, i could've gone with them and eventually get Spanish papers but i didn't want to let go of everything i have here. A loving boyfriend, amazing friends and the comforting surroundings.
So here i am about to live illegally in the US without a car without a license and without any hope. My mom introduced the idea of getting married to my very legal boyfriend and that's exactly what i did. We got married in April 2009. He was very willing to help me, he loves me to death and i'm very grateful for all of his help. But... we didn't really think things through very well. His parents are completely against his getting married so young and they have no idea what we've done. Along with this, we decided against getting a lawyer [i'm the one paying for everything btw] because we thought we could fill out all our papers on our own. This is all put on pause as of right now because of some other possible option.
My actual father moved to california when i was 12. He actually got married for papers but encountered some tax problems. during my junior and senior year he told me he would petition me but of course never did because he didn't have any money. He is a resident right now about to apply for citizenship in november. I am recently on speaking terms with him [mostly because i have to] and he told me he could petition me now and once he got citizenship things would be great. He says he should get citizenship in jan/feb. Now, i don't know if the process is really that quick or if he's lying to me because he knows my situation sucks.
So i have a few options:
One -Wait for my father [who isn't very reliable] to petition me. i get that car and drive illegally [which my mother is very against]
Two- Go through with my marriage deal. Keeping in mind that me and my boyfriend don't live together and his parents don't know about our marriage. Oh and if i do this i wouldn't be able to get the car because i would be spending all my money on the papers. In that case i wouldn't be able to work.
Three- Wait for my father to petition me but still keep the money i've saved up by not buying the car. This would mean i couldn't work for a long time.
Ugh this is really long and i doubt it makes any sense but i'm in big need of some advice because my situation is horrible. Any input would help.

Hi and Welcome

I'll try to answer your questions, as far as I know when a parent petitions for a child over 21 it takes years not sure how many but a few, When it comes to marriage now that's the fastest way only a few months 3 or 4 but you should be careful it they think something is wrong it could be bad but as long as you do everything they tell you and act casual everything should be fine. Now when it comes to buying a car I'm not sure how the laws are over there it's always a risk I don't know sorry.

I would say getting married is the fasted way- which you already have done with your boy-friend. Once the paper work is submitted and you have had your interview it usually takes about 3 months.

BUT! I suggest you go to the interview with a lawyer! Even if you can't pay for a lawyer to do all the paper work maybe you can hire one for the interview... you will need to show some additional paper work which show that you live together.. for example bills to the same address, a signed lease.. (again try finding a lawyer you can speak to about this , many of them offer free consultations) furthermore, there needs to be proof that your boy-friend can financially support you. I believe he would need to show tax papers as well. If he does not make that much, you can have another person sign this form stating that they are helping you out. For example my friend just married her candian husband and becuase she is the citizen she had to show that she can support him- she has never worked, so her parents signed the form.

Also it is very possible that they will check to see if you live together.. again they did this with my friend. (they went to her house 3 times because everytime they went her husband was not home, so they kept going until he was there). Again you can get a lease from a home owner that you are renting a room from.. since you are both young it makes sense.

Last thing, I am not sure if his parents not knowing is an issue.. you should seriously consider a speaking to a lawyer. Even if it is a $100.00 consultation fee it is completely worth it. You are doing the right thing, the fastest way to get your papers- and you just want to make sure you don't screw it up only to save a few hundred dollars.

Anyway, hope that helped. I am really glad that you have this wonderful boyfriend who is helping you in your time of need. I myself was with someone for 5 years and he still said no.... so you are way ahead of me!

I would go with the marriage option but My lawyer told me marriage could never get an undocumented legal. That Homeland Security requires proof of legal entry to the US before an adjustment of status can be done even if I am married to a US citizen . Is this true?

Here is the process as I understand it, if the parent that petitions you is just a resident the wait time could be as much as a decade, however, once that parent becomes a US citizen you are moved along and it could take 3 years. The advantage with doing this is that with the documents stating that you are in the process of getting legal citizenship you might be able to get a driver's license. At least that is what my parents have learned, they will be going through this process if the DA does not pass, at least so I can drive legally.

but marriage is indeed much faster, and would give you the possibility of not only driving legally but working as well, and it takes a much shorter time.

That is not true. Your lawyer is not informed. An undocumented can get legal through marriage. The process is different though. You have to go to your home country and submit a waiver for your illegal presence in the US. Then you fiance/husband has to submit an extreme hardship letter telling why he/she cant move to your country. Its a long process but it can be done. Alot of people have gotten legal through this process. For more info visit immigrate2us.net. They are experts in these type of processes and know more about it.
