Hello everyone,

I have a question regarding an immigration case that I am currently facing.
I was detained by Immigration and I am currently waiting on my court date. What I would like to know is if the Dream Act were to pass while I am awaiting my court will I still be eligible to apply under the Dream Act. I do meet all the requirement that are listed within the Dream Act.

All replies would really be appreciated.

Thanks.

I have no idea, it can be found somewhere in the text of the bill (pre-amendments so it can change once it hits the floor). I am sure somebody in this forum knows.

And if you dont mine me asking....How were you detained?

I don't see why you wouldn't qualify since I don't think being placed in proceedings is a bar to the possible immigration benefit. There have been more than a few occasions where removal proceedings have been cancelled outright if someone has a valid claim to immediate residency.

This shouldn't be too surprising since most proceedings begin this way if you look at the statistics.
