I think I'm out
Someone in another forum, in the same situation but with a student visa I think, had the same question ,and someone brought this to his attention

This is when being Legal, is worse then being Illigal (In case dream act pass)

But if you qualify for everything (the 5 years, clean record, 2 years of college, age at entry, etc etc etc) I really think you'd be covered by Dream. There might be a loophole in there though, I don't know.

I am also in the US with a TPS, and it is my understanding that we would benefit from this Act as long as we qualify with the requirements. Such as being here before you were 16, attending college, etc.

so keep your hopes up and fingers crossed!

that's right. the one that only required college was the previous one that was rejected, so Durbin decided to work with someone that opposed the act and they added the alternative 2 years in the military to work as another road someone could take and placed an age restriction on the act, you can be only up to 35 to qualify, and I think they also changed the minimum age by 2 years.

btw as of this moment there are 87 co-sponsors in the house and 23 in the senate.

I posted this on a seperate thread but didnt get a response.

I came to this country at age 15 on a G-1 ( child of a dimplomat visa). I attended high school graduated and adjusted my status to a F-1 visa after parents left to complete colllege. Due to a marriage not working out and a divorce following soonafter i was left out of status.

Does Dream act also apply to those who were admitted properly but chose to remain behind under their own will ?! I qualify for all the other criteria i.e. admission before 16, high school, 4 year college etc etc.

I think you would qualify. as long as you meet the requirements then youre good. Cuz i mean, as far as i know, the DA doesnt specify how the people had to enter the US. some entered illegally and some legally. so i believe youre good man.

I'm in the same situation, So if dream act passes this year or next year 2010 (when I would graduate HS) I would have to file something with then immigration office right, the wait like idk how long till it comes back and then enlist?

If you are legal, speak to a recruiter. They'll offer anything these days, maybe even a green card. I know that students that are legally in the US for at least 2 years and still have a legal status and their visa still didn't expire - they could join the military and get a green card.

what if I your visa is expired? I mean I really want to join the NAVY. Should I just got tell my recruiter my situation?
