LOS ANGELES -- A federal judge has ruled that adult children who turn 21 while waiting for family-sponsored green cards have to wait anew once they "age out" of their parents' applications.

U.S. District Judge James Selna ruled in Los Angeles against a group of immigrants with green cards who sued the federal government, arguing a 2002 law means grown children should be allowed into the country when their parents file new paperwork on their behalf.

Friday's final ruling means the plaintiffs' children who became adults while waiting for processing must start the application process from the beginning.

Immigration attorneys say thousands of immigrants have waited a decade or more for their older children to join them in the U.S.

Plaintiffs' attorney Carl Shusterman said he plans to appeal.

this isnt great news at all...from my understanding it says that ppl who age out have to start all over again, how is that great?

I have been fighting this for more than a year now. There's still more appeals on the way but at this point, I'll rather put myself in removal. The USA doesn't deserve me.

Aww, crap.

Does this affect me as a principal beneficiary in the F2A category? Or is it only derivative beneficiaries of parents who are still waiting to adjust status?

So what does this mean? This judge can just reverse a federal law passed in 2002? Even from California? Does this affect the entire country?

Can her ruling be overturned? This is the highest degree of unfairness any human (especially a "judge") can favor.

The Shusterman case is a district class action, right? Apparently, there are several law suits pending against USCIS related to the CSPA.

The national class action lawsuit, Costelo v. Chertoff, has yet to be ruled on. And the lawyer I spoke to from Reeves and Associates (lead counsel), Nancy Miller, told me that the ruling will not be out until later on this year or early next year. However, it is the same judge, James Selna, that certified Costelo v. Chertoff as a class action lawsuit and later ruled in favor of USCIS in the Shusterman case.
