i'm new here and in the current situation. Should I go through with my Adjustment of Status through my Legal resident father since I think there is no hope because my visa expired and i'm out of status or should I just keep with it and keep waisting money just to keep having my name in the system? I don't know what to do my priority date is next month and it looks like I will get denied and idk if getting denied means automatic deportation.

Last hope, I don't think your situation is stated clearly enough for us to comment. Also it looks like it would involve a lot more legal advise than any of us would be able to give properly. How old are you? If you're over 21 then you would be considered an adult and it would be harder to adjust your status even though your father is a legal resident. If you're under 21 then look at filling out the document 1-130. What document do you have to adjust your status from?

But look, I believe in taking chances otherwise if you keep waiting then the situation may just become worse. I think the best thing is to get a good immigration lawyer if you want to try and adjust status. If you choose to keep waiting, then I would like to welcome you to the club. Dream Act is the only hope a lot us have. Hopefully you meet the requirements for the Act.

f2a family petition I was petiotioned as a child but after 2001 and I'm 21 but qualify for Child Status Protection Act.But From the requirements to become resident you cannot be overstayed or you will get denied so I would get denied because i'm out of status before my priority but the last hope I have is the dream act.
