Family About To Be Deported !! Need Advice - Page 2

I finally was able to contact her,they are taking her to san antonio, we couldn't get a hold of lawyer seems they are all off today. But hopefully we can get one on monday so they can fight the case if there is one. Anyone else had this happened to?
she actually speaks english, but said in jail they were asking everyone not only Hispanics where they were from. So I guess anyone who is arrested will probably be deported if not legal.

And she has applied for green card and been married since 2006 or 07. the lawyer said to contact him whenever this if ever happened we tried contacting him, but answering machine was off. Do you think we should stick with him? or find another one people have recommended another lawyer. Thanks

For now you should stick with the attorney, and keep trying to contact him. If she does not sign anything she will be going to court and she will have some time. It is of great importance that you guy's have an attorney that you trust.

I hear this a lot but really do not have much info about. What is this 10 year rule and having spent more than 10 years here have to do with a greater chance of not getting deported ?

A person facing deportation could apply for cancellation of removal, as long as they have a no criminal record, good moral character, and have maintained continous presence in the US for at least ten years. They must also have a qualifying relative (such as a USC or PR spouse, child, or parent) that would suffer extreme hardship if you were deported from the US.

It's difficult to be granted COR because the hardship the relative would suffer must be extreme and exceptional, but it is possibility for those facing deportation.

ok some updates,

apparently some class B misdemeanor came up and the lawyer said if she pleaded guilty he will not be able to adjust her status or get her released here does anyone know if thats true?

Tell her defense attorney to try to plea bargain with the prosecutor to a lesser crime. If she is willing to plea guilty to the lesser crime right away the prosecutor might agree to go for a class C misdemeanor.
