Student visa? Please help me.

I'm currently living in a state where in state tuition is not allowed.

I entered the country legally with my family when I was very young. My Visa is now expired and I, as well as my family, have overstayed. I'm currently 16, and a junior in High school. I will be 17 when I graduate as a senior from HS.

My birthday is in July, I know the law says that in order for I to be illegal, I have to have overstayed 180 days after my 18th birthday, therefore I will be legal (well not really) once I graduate high school and even when I apply to college.

If I am accepted to college, I will have to go in as an international student and I will be asked for a student visa. How would I go about on getting one?

My parents are illegal.
My aunt who came with us is now married to a citizen and is not a permanent resident, she has two children with him.

All of my family is here legally except us.

i dont think you would be able to get that since u over stayed ur time. but there is no ban on you because your still young but. im guessing here if u go back to ur country and apply for one there and then come back and you will be able to apply as a international student and receive financial aid i might be wrong, if i am, correct me, but no matter what u can go to any college u want its just that ur parents would be paying ur tuition out the ass since it cost so much

I don't think it works that easily. I looked at your alternative before attending college, but the chances of you getting a visa to come back to the U.S. are very slim. The reason for this is because a student visa is a non-immigrant visa, so the interview officer must see that you are willing to go back to your country of origin once you finish your studies. But, because you have lived here illegally, it will be very hard that you can prove that you will go back to your country of origin.

I agree with hope4me. It'll be hard to prove that you have strong ties to your country of origin if you've lived here for so long. A good amount of money back home, family, and a place of residence of a few years are probably really important factors in proving that you aren't coming to the U.S. to stay.

Are you sure you would need to apply as an international student? What country are you from?

Pretty sure a lot of us here have gotten into state schools with and without instate tuition, without entering as international students. I really don't think you need to apply as an international student... so why do it?

I wish I were 17 again. If I knew this when I was 17 I would have left the country. I am 20 and married now, which helps, but it would have been so easy if I knew the "18 years old" rule back then.
