Yes. Talk to a lawyer! Second, you'll have to file a waiver.. Talk to PrettyJolie, she's in the same boat as you.

Yes!!

You will have to leave the country to adjust, but it's definitely possible. As hef mentioned, you are going to need to file a waiver for your illegal presence.

I'm actually going through the process right now. I entered illegaly as a child, have been married to a USC for almost 2 yrs, and I'm about to leave to Mexico in a few days for my appointments.

Are you looking to hire a lawyer or doing it on your own? Check out this website: http://immigrate2us.net/forum/forum.php

Good luck!! =)

Wow I did not know things have changed so much. When my younger brother married his wife , she only had to do an "adjustment of status" interview here in Los Angeles. She never left the states.

That is either because she enter the country on some sort of visa and overstayed it or because she filed under i245. The people who posted in this thread enter the country illegally (through the border) thus their process is different.

It all depends on your case. If approved through the pilot program, people are out of the country a few weeks. If backlogged, it could be 12-16 months.

In my case, we are filing an expedite because my husband is deployed. If I'm approved, I won't be here too long. Someone I know was recently approved (her husband is deployed too) and she spent less than a week in Mexico.

As of right now, I'm banned for ten years. It's pretty crazy. I can't return now that I left the US unless I am approved this week. So we'll see.

Good luck. I don't think you will have any problems.
