AB540 Help/Advise?

Hi guys so im planning to attend UCD this fall quarter; however, I cannot do so without applying as an AB540 student. The problem is that we overstayed our visa (B1) and for that I do not know if I still qualified for the program. The registrar told me to sent another affidavit stating that I do not have a visa and notarized it-stating that I made a mistake on the first one. Every other application that asked for my status-especially SLR forms I stated that I have an expired visa. So I don not know what to do and I am wondering if anyone have an advice on how to approach and solve this dilemma. Thanks in advance!!

First of all, be Truthful. Never lie.

Secondly, how did you fill in the affidavit. I am assuming the problem was in your second part of affidavit which is about immigration status.

Which one did you check?
If you checked the first one which is "I am a non immigrant, and i currently hold one of the visas ...." then that could be the issue with your original affidavit.

If you picked this ( assuming you do not have any of those visas) then you made a mistake in filling it.

If you do not have a legal status and you are an undocumented person then i think you have to pick the second option ( I am not a non immigrant, ... ) .

I am guessing you probably picked the first one and then said something like " My visa is expired". So yes, if you did pick the first one then you were at wrong.

You should probably wait and read other people's input as well. Also if you are confused, then the best thing is probably to talk with your registrar. He/she will probably be able to provide you with the most accurate answers you are looking for.

Again be truthful and do not lie and i think you should be fine. Best of luck.

lol bro ay yea bro just stay away from telling davis u got an expire visa......everything should work out on the second application as long as again u stay away from telling them u got an expire visa don't worry...you're in already just a small error....and good luck on your 1st year hope everything works out...and go aggies!.......plus remember even if u do got an expire visa u still qualify as an ab 540 student cuz u went to high school here and got a diploma...and everything else....so don't trip....best of luck bro!......

@ above post, even if you have gone to a California high school for 3 years and have gotten your diploma here, if you are a non immigrant student ( with legal status), you do not qualify for AB540.

So stay away from lying. It could destroy your chances of ever getting legalized in future.

@Bluestar: thank you for the feedback and so even though my visa is expired I do not qualify for the program? and what do you think I should do?

@xavier07; I know bro....im freakin out!!!! coz i cant afford this crap without ab540...

Talk with or email your registrar and ask them. But based on your description i think you do qualify for AB540.

Assuming you do not have a legal immigration status, based on the link i posted earlier it seems you do qualify. You need to also have been studying in a California high school for 3 years and graduated from one as well.

But again, do not take my word. I do not know your exact circumstances. Ask your admission or registrar office.

I graduated from a UC with the help of AB 540. I qualified for the exemption because I overstayed my tourist visa many years ago and attended a high school in California for at least three years. Even though I was admitted to the U.S. legally with a temporary visa, the period of lawful admission has expired, allowing me to qualify for tuition exemption. If you are in the same situation as I, then you DO qualify for the exemption as well.

It is possible that you incorrectly filled out the form. You're not supposed to indicate that you have legal presence in the U.S. because of a visa (because you don't. You did once, but you no longer do). I think you should contact the residence deputy at UCD for more information.

Hey guys thank you for all of your help. The confusion is now settled lol. I now qualify to the program. Now hopefully, Jerry Brown wins the election and not Whitman lol
