Apparantly "Initial Entry" is a new concept in immigration

I learned that "Initial Entry" was a new concept that didn't exist in prior immigration Laws.

Prior immigration laws have just two concepts; "Entry" and "Reentry". "Initial Entry" was a new concept to the the immigration lawyer I talked, so he could not define what it meant and how it related to my case.

I did check a number of immigration laws, and indeed there was no term called "Initial Entry" in past laws.

I am beginning to be afraid.

True.

The interpretation of the word might disqualify you. Or it might not disqualify you.

If it doesn't disqualify you, that's amazing. You're lucky.

If it does disqualify you, then you have to look at what to do next. Being worried won't solve anything, it will just stress you out. So get some relief from your stress, and when you're ready, work on a plan-B, whether it's CIR, marriage, whatever.

All these negative thoughts are all in your head. It's separate from reality.

initial entry most likely is a term for when you entered us the first time (as there is a provision in it for being out of country for up to 90 consecutive days or 180 total days during the 5 year period, which while being undocumented cannot be legally achieved), its probably there so no nutjob judge will be able to give you a perm ban in case it did happen.


however with the burdello going on in immigration stuff i wouldnt be surprised if we will have to ask the scotus for a definition ...

Bad news.

I heard from a deportation trial lawyer. He says "Initial Entry" as used in immigration proceeding is the first entry for a specific visitation purpose. The date of initial entry is reset if the alien departs the US for longer than a specific permitted period, and the next visit would be another initial entry for immigration purpose.

Since the maximum permitted departure from the US under Dream Act is 90 days per trip, my initial entry date of current visitation would be 2002, not 1992.

In other word, you are disqualified if you have left the US for longer than the permitted duration since the entry before 16.

What is EWI? if you are talking entry without inspection, i came with a valid visa.
