Kids can be influenced by their parents to study abroad. You fail to see this point. Most dreamers knowingly choose to stay undocumented even after they become aware of their status. Fact is overstayers gone through border inspection and DID NOT break any law while entering. Also overstaying is a civil offense. Abuse can be interpreted as to have been obtained fraudulently or trying to get covered under DREAM while on valid student status. We can go back and forth on this all day. I just want legit interpretation of this clause.

Yeah, it's bullshit that people who overstayed their student visas seem to now be disqualified.

Amen to everything gebodupa said. A large chunk of Dreamies are getting disqualified, even if they already have (one or more) college degrees, and qualify under everything else. To put an age cap is cruel. If the DREAM Act doesn't pass during the lame duck session, then it will be clear that Republicans don't intend to pass anything immigration-related anytime before the 2012 elections (except for more border security, of course).

Also, we can get deported at any time during the process?? WTF!? And the 'conditional non-immigrant' status is pure bull crap. Congrats to everyone who still qualifies, and good luck if it does indeed pass, but after I get my Bachelor's (got 3 semesters left) I will either try to make my way into the UK, Canada, or last resort back to my home country, because this is pure B.S.

Well lots of people are feeling this. I am not an exception. This country is seriously going down the tubes: economy, teabaggers, xenophobia, deficit, debt, unemployment, Sarah Palin. While other countries are growing rapidly. This is really a shame that GOP is willing to abandon young people willing to revive this country. Well for me at least, with Dream or not I'll be finishing up my engineering degree and will decide from there.

I hope everyone gets covered if a bill does pass, but it was YOU who made the comparison about who is in a better position to receive the benefits

Overstayers DO in fact are in better position. They can at least certify their identity with approved documentation from DHS. Jumpers? not so much.

I'm pretty sure that in your first post the term "better position" wasn't referring to having a better chance at certifying their arrival date. I'm also pretty sure that you were trying to say that overstays were more deserving of the dream act then "jumpers" since they crossed "legally"
