Yep, it's better not to take anyone's word on what's in the bill at the moment, since there is a lot of false information out there right now.

it depends on the misdemeanor. If the charge is punishable by more than 1 year in prison the person wont qualify. most petty theft charges only carry a maximum of 1 year in jail.
