You have a point there re: record-keeping and the hardship waiver.

Here's a "no shit, Sherlock" comment. Leaving the US as an undocumented immigrant is just so risky in that your return is uncertain. Even more so if you were documented and then fell out of status. That's why I'm hoping- and it's most likely an unrealistic hope- that with CIR the 10-year-ban will be removed. It will be easier for immigrants to adjust status without the threat of the 10-year-ban.

My question would be, is there more than one person with your name in the United States? Chances are there are multiple. How would the government know you from them if your only looking at school records.

How are they really going to know if they don't know what town to search anyway? You could also ask for your record after a certain number of years, I believe. Maybe take it with you.

Good point! I think the only thing that might for sure mess you up is if you filed taxes with a tax id # or worked here.

He's not lying, just presenting a valid (if very pessimistic) point. Yes, you can apply again for re-entry, but based on what I've read about other people's experiences, getting that application approved will be difficult. That's not to say it's impossible to re-enter the US legally, just more unlikely.

I ve done a lot of research on it.

If you fly, your name enters a passenger list and that list is transmitted to the American government.

Other than that, Customs and Borders have access to some IRS records, FBI, DMV etc. Now what do these data entail, I am not sure, but it should be closer on being on the light side than on the heavy side. For example, I am paranoid about DMV records, but they most probably have vehicle registration records; that means don't cross the border with your car. Same with IRS: They probably look for tax evaders. Same with FBI: they re probably looking for wanted criminals.

In other words, I do think that if you sneak out, there's a decent chance to return without the ban, but it's not foolproof.

Well, you just kind of leave without telling them you are leaving, kind of like how if you EWI you didn't tell them you came in the first place. I mean that is if you dont have a paper trail in country, other than school records. Because I am positive they won't look for that. Every school record in the country doesn't exist in a database, or we would have all been caught years ago.
