kbs111- K1 Visa is only if my wife and I werent already married. It is a Visa for intent to marry once entered into the US. Unfortunately my wife and I have exusted every avenue. The only option was the DREAM Act although the revised age limit of under 30 was going to screw me regardless. I just turned 30 this year. What it is coming down to is me having to go back to Brasil. I got here when I was 13. I have been in the US longer than I spent back in Brasil. My wife and I have 2 kids and im going to have to leave them all here and go back. Then she can apply for me. But that can take years. Another friend of mine ended up going back and he has been waiting for 5 years. USCIS doesnt care if you have kids, are married to Americans or how long you have been here. They will keep you out as long as they can. And now with DREAM not passing it just adds fuel to the fire.

I understand that you don't want to leave your children. Can't blame you. But you can't wait forever. You have an opportunity that many people would love to have. It's no guarantee, but it's definitely worth a shot. What happens if you are detained and get deported? Then you'll be forced to be away from your children and not only will you need a 601 waiver but also a 212 waiver for deportation. You have to think of what is best for your children's future. I don't know your situation, but just bc your friend is stuck outside the US for five years does not mean that is the norm.

If your friend is in Brazil that long, there's a good chance that he's done something wrong and may not be eligible for a waiver. But if you and your sister have no criminal background, orders of deportation, etc you should both have your spouses petition you. And please, consult with a lawyer who knows what he/she doing.

You can apply for a K3 visa, instead of a K1, the K3 is for the foreign-citizen spouse of a USC, but you would have to leave, and that would trigger the ban.

she should go to a hospital they wont call ICE on you I promise(past experiences). BY LAW an unborn child in this country is a USC. its not her getting the treatment its the baby. or if you're in Miami Florida, go to Jackson Memorial Hospital she will get the help she needs there.

My mom had two children here...your sister NEEDS to see a doctor, they won't call ICE or anyone. Sure the moment may be awkward explaining she doesn't have a SS, but one awkward moment is worth going through to ensure her child is healthy! One of the biggest causes of birth defects is poor prenatal care. At 6 months I hope she has been taking care of her and the child well.
